“Three -Strip” Battle in European Union Faced by ADIDAS

Adidas registered a figurative mark consisting of ” three parallel equidistant stripes of identical width” in 2014 for goods including footwear, clothing and headgear.

Said registration was challenged by Belgian company ” Shoe Branding Europe” and the Board of Appeal declared the trademark invalid in 2017.

The EU General Court has upheld a decision that Adidas’ three-stripe trademark is invalid.

Adidas had failed to establish that the mark had acquired “distinctive character” throughout the European Union.
